1. Acceptance of Terms

By accessing and using the Jersey Lunatic website and making a purchase, you agree to be bound by these Terms of Service. These terms establish the contractual conditions for your purchase and use of our website. We reserve the right to modify these terms at any time. You must be at least 18 years old to purchase from Jersey Lunatic. By placing an order, you confirm that you meet this requirement and have the legal authority to enter into a binding contract. If you are under 18, you must obtain parental or guardian consent before making a purchase.

3. Your Account

If you create an account, you are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must provide accurate, current, and complete information during registration. You agree to notify us immediately of any unauthorized use of your account.

4. Product Descriptions and Colour Variation

We make every effort to ensure that product descriptions, images, and specifications are accurate. However, we do not warrant that descriptions, images, or pricing are error-free. Product colours may vary between your computer screen, mobile device, and the physical product due to differences in display settings and lighting. This variation is normal and does not constitute a defect. We recommend viewing products on multiple devices before purchase if colour accuracy is important to you.

5. Pricing and Price Errors

All prices are displayed in EUR (Euro). Prices are subject to change without notice. If a price error occurs on the website, we reserve the right to refuse or cancel any order placed at an incorrect price, even after order confirmation. In the event of a pricing error, we will notify you and offer the choice to cancel your order or proceed at the correct price. Taxes and shipping costs are calculated and added at checkout.

6. Order Formation and Right to Refuse

The submission of an order constitutes an offer to purchase. We reserve the right to refuse, cancel, or place on hold any order at our sole discretion. Orders are not confirmed until we have processed payment and sent an order confirmation email. We may refuse orders that appear fraudulent, are incomplete, or contain inaccurate information. We also reserve the right to refuse or cancel orders from customers who have violated these Terms of Service or engaged in prohibited conduct.

7. Payment

Payment must be received before your order is processed and dispatched. We accept the payment methods displayed at checkout. By providing payment information, you authorize us to charge your account for the full order amount, including any applicable taxes and shipping costs. You are responsible for ensuring that your payment information is accurate and current. If payment fails, we may attempt to process the payment again or cancel your order.

8. Personalization

Critical: When you order a personalised product (including shirts with your name, number, or custom design), you accept full responsibility for the accuracy of the information you submit. This includes:

  • Correct spelling of names and text
  • Correct shirt size and other specifications
  • Correct placement and sizing of any design or personalization

Once production has begun, personalised products cannot be altered or cancelled. Personalization must be confirmed and submitted accurately before checkout. We are not responsible for errors in personalization resulting from information you provided.

Personalised products are FINAL SALE and cannot be returned, refunded, or exchanged under any circumstances, except for manufacturing defects affecting the base garment (not the personalization itself). This is an absolute restriction and cannot be waived or negotiated on a case-by-case basis.

9. Intellectual Property and Trademarks

Jersey Lunatic and its logos are trademarks of Jersey Lunatic. All content on this website, including text, images, graphics, and code, is the property of Jersey Lunatic or licensed to us by third parties. You may not reproduce, distribute, transmit, or display any content without our prior written permission.

Football club crests, team names, and league logos are the intellectual property of their respective owners, including clubs, leagues, and governing bodies. Jersey Lunatic is not affiliated with, endorsed by, or connected to these organizations. All rights to these marks and logos remain with their rightful owners. We operate under license or with permission where required.

10. Prohibited Conduct

You agree not to:

  • Violate any applicable law or regulation
  • Harass, threaten, or abuse our staff or other customers
  • Engage in fraudulent activity or attempt to obtain products through deception
  • Attempt to gain unauthorized access to our systems or networks
  • Use automated tools, bots, or scripts to access the website or place orders without authorization
  • Submit false, misleading, or defamatory content
  • Infringe on intellectual property rights
  • Reverse-engineer or attempt to discover the source code of our website
  • Spam, flood, or conduct any form of denial-of-service attack

11. Limitation of Liability

To the fullest extent permitted by law, and provided this does not exclude our liability for data protection violations, fraud, consumer rights violations (including cooling-off period rights, legal guarantee of conformity, or right to cancel), or personal injury, Jersey Lunatic is provided on an "as is" and "as available" basis. We do not warrant that the website will be uninterrupted, error-free, or free from harmful components. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or products, even if we have been advised of the possibility of such damages. This includes loss of profits, data, or business opportunity.

Our total liability to you for any claim shall not exceed the amount you paid for the order in question.

For consumers (individuals purchasing for personal use): Disputes arising from your use of this website or your purchase may be resolved in the courts of your country of residence or in Spain, at your choice. You may also pursue alternative dispute resolution methods available in your country before initiating court proceedings.

For non-consumers (businesses): These Terms of Service are governed by the laws of Spain, without regard to its conflict of law principles. Both parties consent to the exclusive jurisdiction of the courts located in Spain.

Jersey Lunatic reserves the right to amend these Terms of Service at any time. Changes will be effective immediately upon posting to the website. Cancellation and Returns – EU Directive 2011/83/EU: Under EU consumer law, you have the right to cancel your order within 14 days of purchase without providing a reason. However, this right of cancellation does not apply to personalised or personalised products. Personalised items (including shirts with your name, number, or custom design) are explicitly excluded from the 14-day cooling-off period because they are made according to your unique specifications and cannot be resold. To exercise your cancellation right for non-personalised products, contact jerseylunaticsupport@gmail.com within 14 days of receipt, providing your order number. Refunds will be processed within 14 days of receipt and inspection of returned goods.

Legal Guarantees: All products are subject to a 2-year legal guarantee of conformity under EU Directive 2019/771. If a product is defective or does not conform to the contract at the time of purchase, you may claim repair or replacement during this period. This guarantee covers defects in the base garment and manufacturing quality, but does not cover damage resulting from your personalization instructions or normal wear.

Dispute Resolution: If you have a complaint, please contact us first at jerseylunaticsupport@gmail.com. We will attempt to resolve the matter within 30 days. If we cannot reach an agreement, you may pursue alternative dispute resolution through your national consumer authority or seek legal action through the courts.
